1. Agreement to Terms
By accessing and using Sites for Trade services ("we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not use our services.
2. Services Description
Sites for Trade provides monthly subscription-based website design, development, hosting, and maintenance services for tradespeople and small businesses.
2.1 Service Tiers
- Starter Plan (£59/month): 5-page website, mobile responsive design, contact form, hosting, SSL certificate, basic SEO, Google Analytics, and monthly updates.
- Professional Plan (£99/month): All Starter features plus up to 10 pages, advanced SEO, Google My Business setup, monthly SEO reports, social media integration, WhatsApp chat widget, customer reviews widget, and priority support.
- Enterprise Plan (Custom pricing): All Professional features plus unlimited pages, custom features, online booking system, CRM integration, multi-location support, dedicated account manager, and 24/7 priority support.
2.2 Launch Guarantee
We guarantee your website will be live within 7 business days from receiving all required content and materials from you. Delays caused by late content delivery do not fall under this guarantee.
3. Payment Terms
3.1 Subscription Fees
Services are billed monthly in advance. All prices are in GBP (£) and exclude VAT, which will be added at the current rate (20% as of the date of these terms).
3.2 First Month Discount
Professional Plan subscribers may receive a first-month discount (£69 instead of £99). This is a limited-time offer and may be withdrawn at any time.
3.3 Payment Methods
We accept payment by credit card, debit card, and bank transfer. All card payments are processed securely through Stripe, our payment processor. We do not store your card details on our servers.
Payment is due on the anniversary of your subscription start date each month.
3.4 Late Payment
If payment is not received within 7 days of the due date, we reserve the right to suspend your website until payment is made. After 30 days of non-payment, we may terminate your account and take down your website.
3.5 Setup Fees
We charge no setup fees for any plan tier.
4. Client Responsibilities
4.1 Content Provision
You are responsible for providing:
- Written content for all website pages
- Images and media files
- Company logo and branding materials
- Accreditation certificates and credentials
- Any other materials required for your website
4.2 Content Licensing
You warrant that you own or have proper licenses for all content you provide, and that using such content does not violate any third-party rights.
4.3 Timely Communication
You agree to respond to our communications within 3 business days to ensure timely project completion.
5. Our Responsibilities
5.1 Service Delivery
We will:
- Design and develop your website according to your chosen plan
- Provide secure UK-based hosting with 99.9% uptime guarantee
- Install and maintain SSL certificates
- Perform monthly updates and security patches
- Provide technical support during business hours (Mon-Fri, 9am-5pm GMT)
- Create regular backups of your website
5.2 Uptime Guarantee
We guarantee 99.9% uptime, excluding scheduled maintenance (notified 48 hours in advance). If we fail to meet this guarantee, you may receive a credit equal to one week's service fee.
6. Intellectual Property
6.1 Your Content
You retain all rights to content you provide. By providing content to us, you grant us a license to use, modify, and display it solely for the purpose of delivering our services.
6.2 Website Code and Design
The underlying code, design templates, and technical infrastructure remain our intellectual property. Upon full payment, you receive a non-exclusive license to use the website for your business purposes.
6.3 Portfolio Usage
We reserve the right to display your website in our portfolio and marketing materials. You may opt out by written request.
7. Cancellation and Refunds
7.1 Cancellation Policy
You may cancel your subscription at any time with 30 days' written notice. Your website will remain live until the end of your current billing period.
7.2 14-Day Money-Back Guarantee
If you're not satisfied within the first 14 days of your subscription start date, you may request a full refund. After 14 days, payments are non-refundable.
7.3 Post-Cancellation
Upon cancellation:
- Your website will be taken offline after the current billing period ends
- We will provide you with a backup of your content upon request
- Your domain (if registered through us) will be transferred to you or cancelled according to your instructions
- We are not responsible for maintaining backups after cancellation
8. Website Ownership After Cancellation
If you wish to take your website elsewhere after cancellation, we can provide:
- A complete backup of your website files and database
- Content export in standard formats
- Domain transfer (if applicable)
Please note that the website code and design are our intellectual property, but we will assist in migrating your content to another platform.
9. Service Modifications
9.1 Monthly Updates
Your plan includes reasonable monthly updates to content, images, and minor modifications. Major redesigns or new features may incur additional charges.
9.2 Scope of Updates
"Reasonable updates" are defined as:
- Text changes up to 500 words per month
- Image replacements (up to 10 images per month)
- Contact information updates
- Menu and navigation changes
- Gallery updates
9.3 Additional Work
Work outside the scope of your plan will be quoted separately and billed at £60/hour for development work.
10. Prohibited Uses
You may not use our services to:
- Host illegal, obscene, or offensive content
- Distribute malware or engage in phishing
- Violate any applicable laws or regulations
- Infringe on intellectual property rights
- Send spam or unsolicited communications
- Resell or redistribute our services
Violation of these terms may result in immediate service termination without refund.
11. Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for any indirect, incidental, or consequential damages
- Our total liability is limited to the amount you paid in the previous 3 months
- We are not responsible for losses caused by circumstances beyond our reasonable control
- We are not liable for content you provide or third-party integrations
12. Warranties and Disclaimers
Our services are provided "as is" without warranties of any kind, express or implied. We do not guarantee that:
- Your website will achieve specific search engine rankings
- You will receive a specific number of enquiries or customers
- Your website will be error-free or uninterrupted
- All third-party integrations will function perfectly at all times
13. Third-Party Services
We integrate with third-party services to provide our services:
- Stripe: Payment processing for subscription payments. Your payment information is handled securely by Stripe and is subject to Stripe's Privacy Policy and Terms of Service.
- Google Services: Google Analytics, Google My Business integration.
- WhatsApp: Chat widget integration (optional).
- Other Integrations: Social media platforms, review widgets as applicable to your plan.
Use of these services is subject to their respective terms and conditions. We are not responsible for third-party service failures or changes.
14. Data Protection and Privacy
We process personal data in accordance with UK GDPR and the Data Protection Act 2018. Please refer to our Privacy Policy for detailed information.
15. Changes to Terms
We reserve the right to modify these terms at any time. We will notify you of significant changes via email at least 30 days before they take effect. Continued use of our services after changes constitutes acceptance of the new terms.
16. Price Changes
We may change our prices with 60 days' written notice. Existing customers will be grandfathered at their current price for 12 months from the date of the price change announcement.
17. Disputes and Governing Law
17.1 Governing Law
These terms are governed by the laws of England and Wales.
17.2 Dispute Resolution
In the event of a dispute, we encourage you to contact us first to seek an informal resolution. If we cannot resolve the issue, you may pursue formal dispute resolution through UK courts.
18. Force Majeure
We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including but not limited to: natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or supplier failures.
19. Entire Agreement
These Terms and Conditions, together with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and Sites for Trade.
